29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit:  Sterling concrete mixer truck (Truck number:1220): On or about January 19, 2016 and at times prior there to, employees were exposed to engulfment hazards, while chiseling hardened concrete from the inside of a mixer drum without the use of a site specific confined space permit.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:   Sterling concrete mixer truck (Truck number:1220): On or about January 19, 2016 and at times prior there to, employees were exposed to engulfment hazards, while chiseling hardened concrete from the inside of a mixer drum without being trained on the procedures to work in a confined space.

The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  City of San Antonio Work Yard: Sterling Cement Mixer Truck (Truck Number:1220) On or about January 12, 2016 and at times prior thereto employee(s) were exposed to the startup and rotation of the cement mixer drum, while climbing inside the cement drum to remove hardened cement and the cement drum was not locked out.
