29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Zippy Carwash: On or about January 27, 2016 and at times prior thereto the employer failed to establish a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met for GS -125 multipurpose degreaser which is corrosive and may cause burns to eyes and skin if improperly used; High foaming lubricating detergent which may cause allergic skin reaction; High foaming low pH lubricating detergent which may cause severe skin burns and eye damage.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) Zippy carwash: On and about January 27, 2016 and at times prior thereto the employer failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment. Employees used different products that contained hazardous chemicals such as but not limited to GS 125 multipurpose degreaser which is corrosive; High foaming lubricating detergent which may cause allergic skin reaction; Cherry scented High foaming low pH lubricating detergent which may cause severe skin burns and eye damage.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a)Zippy Carwash: On or about January 27, 2016 and at times prior thereto the employer exposed employees to amputation, caught-in and struck-by hazards from vehicle conveyor chain due to employers' failure to establish a program consisting of an energy control procedure, employee training and periodic inspections for the purpose of controlling hazardous energy sources. Maintenance employee used emergency stop as a means of controlling hazardous energy source during maintenance and servicing.
