OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of falling from a pallet supported by rough terrain forklift.      Power Building and Design Inc. project site located at 2100 N. Hard Dr. Appleton, WI: On 2/22/16, an employee was exposed to falling while working from a pallet supported by a Caterpillar TH255 rough terrain forklift.      Among other methods, a feasible and acceptable means to correct this hazard is to understand and follow the ANSI Safety Standard for Rough Terrain Forklift Trucks, B56-6.2005, section 5.15, Elevating Personnel, section 5.17, Operator Training, and section 8.24, Platforms for Elevating Personnel, which list the precautions to be taken when lifting personnel and the criteria for personnel platforms.

Hard Dr. Appleton, WI: On and before 2/22/16, the employer did not ensure each forklift operator was trained and certified to operate the type of equipment and attachments used for elevating personnel.

Power Building and Design project site located at 2100 N. Hard Dr. Appleton, WI: On 2/22/16, two employees were exposed to falls while setting purlins while standing on a wall girt.
