29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about February 22, 2016, and at time prior thereto, employees were unloading paint from a trash box approximately 35 feet high. The trash box became unstable as the paint buckets were being unloaded and crashed to the ground with an employee inside. The employer did not train employees to recognize the hazards associated with scaffolding.  Note: The training shall include the following areas, as applicable:  a)  Any electrical hazards, fall hazards and falling object hazards in the work area; b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c)  The proper use of the scaffold, and the proper handling of materials on the scaffold; d)  The maximum intended load and load-carrying capacities of the scaffolds used; and e)  Any other pertinent requirements of this subpart.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.    On or about February 22, 2016, and at times prior thereto, employees were unloading paint buckets through the fourth story window of the hotel under construction up to approximately 35 feet high from a job-site made wooden trash box. The box was elevated by a rough terrain forklift and was not properly secured to the forks. The trash box was not designed, constructed or loaded for the purpose of its use, exposing employees to a fall hazard.

Part III Section 6 Operator Safety Rules and Practices, 605 Loading, Paragraph A: Handle only stable or safely arranged loads.    On or about February 22, 2016, employees loaded and unloaded paint buckets from a platform on a rough terrain forklift without ensuring the load was arranged in a stable manner to avoid tipping and collapse.
