29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) Jobsite - The employer did not ensure that a stair rail system was installed along unprotected sides of stairs containing approximately fourteen (14) risers, exposing employees to a fall hazard of approximately fourteen (14) feet.  Observed on or about 01 MAR 2016.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Jobsite - Employees constructing a 3rd floor framing project were exposed to a fall hazard of approximately twenty-seven (27) feet without the use of conventional or alternative forms of fall protection.  Observed on or about 01 MAR 2016.  LPS Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 314235243 citation number 1, item number 1b and was affirmed as a final order on 10 MAY 2012, with respect to a workplace located at 1020-1026 South 5th Street, Philadelphia, PA 19147.  LPS Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 908358, citation number 1, item number 1 and was affirmed as a final order on 22 APR 2014 with respect to a workplace located at 1101 - 1111 N. Hope Street Philadelphia, PA 19123.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) Jobsite - The employer allowed employees to lean outside of a third story windows during construction operations exposing the employees to  falls of approx. of twenty-seven (27) feet.  Observed on or about 01 MAR 2016.   LPS Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(14), which was contained in OSHA inspection number 314235243 citation number 1, item number 1b  and was affirmed as a final order on 10 MAY 2012 , with respect to a workplace located at 1020-1026 South 5th Street Philadelphia, PA 19146.
