OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation hazards: On or about March 25, 2016 employees entering the protein pellet grain bin were exposed to asphyxiation hazards from grain engulfment. The employer did not implement confined space entry procedures and processes to address atmospheric, mechanical, safe entry and exit and emergency rescue hazards when entering grain bins. Among one feasible and acceptable method to address these hazards is to follow the instructions of ANSI/ASSE Z117.1-2009 Safety Requirements for Confined Spaces.
