OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation hazards:  On or about March 25, 2016 employees entering the protein pellet grain bin were exposed to asphyxiation hazards from grain engulfment.  The employer did not implement confined space entry procedures and processes to address atmospheric, mechanical, safe entry and exit and emergency rescue hazards when entering grain bins.  Among one feasible and acceptable method to address these hazards is to follow the instructions of ANSI/ASSE Z117.1-2009 Safety Requirements for Confined Spaces.

29 CFR 1928.57(a)(10): Guardrails or fences were not capable of protecting against employees inadvertently entering hazardous area(s):  Employees working on the platform inside the feed truck loading area were exposed to fall hazards of 27 feet 3 inches to the floor below.  A guardrail section was missing near the fixed industrial ladder.

29 CFR 1928.57(c)(2)(i): The mesh or nip-points of all power driven gears, belts, chains, sheaves, pulleys, sprockets, and idlers were not guarded:  Employees accessing the roof of the feed mill were exposed to amputation hazards.  The drive belt and pulleys were not completely guarded.

29 CFR 1928.57(c)(5)(i)(B): Material Handling equipment located in a bulk storage structure was not disconnected, by physically locating on the equipment and electrical or mechanical means to disconnect the power:  On or about march 25, 2016 employees entering grain bins in the truck loading area were exposed to grain engulfment hazards in that the hydraulically operated gates were not locked out prior to employees entering the bin.
