29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. a. On or before May 3, 2016 where an employee was working from a pump jack scaffold, the scaffold platform was constructed from two dissimilar platforms tied together with nylon strapping that was not designed by a qualified person, thereby exposing the employee to a 20 foot fall hazard. Guadalupe Hernandez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1012895, citation number 1, item number 1a and was affirmed as a final order on February 11, 2015, with respect to a workplace located at 7194 Seymour Court, Canal Winchester, Ohio 43110.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a. On or before May 3, 2016 where an employee was working from a pump jack scaffold, the employee was not protected from falls, thereby exposing the employee to a 20 foot fall hazard. 29 CFR 1926.452(j)(2): Poles shall be secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary. When the pump jack has to pass bracing already installed, an additional brace shall be installed approximately 4 feet (1.2 m) above the brace to be passed, and shall be left in place until the pump jack has been moved and the original brace reinstalled. a. On or before May 3, 2016 where employees were working from a pump jack scaffold, the bottom of the poles were not secured, thereby exposing the employees to a 20 foot fall hazard. Guadalupe Hernandez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1012895, citation number 1, item number 1b and was affirmed as a final order on February 11, 2015, with respect to a workplace located at 7194 Seymour Court, Canal Winchester, Ohio 43110.
