29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers:    a. On or about May 16, 2016, at the above addressed jobsite - employees performing carpentry activities throughout the building (second/third) floors were exposed to tripping hazards created by the presence of unprotected and unsecured floor holes measuring approximately four (4) and a half (1/2) to thirteen (13) and a half (1/2) inches wide, and approximately fifteen (15) feet long, thereby exposing employees to tripping hazards.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) On or about May 16, 2016, at the above addressed jobsite - employees and subcontractors employees performing construction activities on the second floor were exposed to fall hazards created by the presence of wall openings, thereby exposing the employees to fall hazards of approximately twenty (20) feet.    b) On or about May 16, 2016, at the above addressed jobsite - employees and subcontractors employees performing construction activities on the third floor were exposed to fall hazards created by the presence of unprotected sides/ edges, thereby exposing the employees to fall hazards of approximately twelve (12) feet    Fogarty Home Improvement, LLC was previously cited for a violation of these occupational safety and health standards or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1009250, citation number 1, item number 1 and was affirmed as a final order on December 30, 2014 with respect to a workplace located at 2319 N. Arlington Heights Road, Arlington Heights, IL 60004.
