29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about May 27, 2016 on the North side of the building, the employer allowed employee to use a Dewalt 4.5 in Grinder (Model # D28402), with an abrasive cutting wheel, to cut a piece of tile without having any eye or face protection on.

29 CFR 1926.303(b)(1): Grinding machines were not equipped with safety guards in conformance with the requirements of ANSI B7.1-1970, Safety Code for the Use, Care, and Protection of abrasive wheels, and paragraph (d) of this section. On or about May 27, 2016, on the North side of the construction site, the employer allowed employees to operate a Dewalt 4.5in Grinder with an abrasive cut-off wheel, with no guard attached.
