29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about June 13, 2016, employees engaged in roofing activities were required to wear respiratory protection and the employer had not evaluated any respiratory hazards posed by the foam roofing product application that included a reasonable estimate of employee exposures during operation and including the identification of the physical form and chemical state of the contaminants present.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) On or about June 13, 2016, employees engaged in roofing activities were required to wear respiratory protection and the employer had not provided the employees with a medical evaluation to determine if the employee could wear a respirator prior to fit testing and/or using the respirator in the workplace.
