OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing and fall hazards: Worksite: The employer did not ensure through providing appropriate means of access, training and specific instructions and visual observation that the employee required to work in an excavation approximately 10 feet deep was accessing to/from the excavation safely at all times. The employee was exposed to crushing and fall hazards while riding the bucket of a Caterpillar excavator in order to access the bottom of the excavation.
