OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving vehicles and equipment.     On or about 19 August 2016, and at times prior thereto, employees were riding on vehicles and equipment in places not designed for occupancy.     (A) An employee was standing on the bumper of a moving flatbed truck that was pulling a trailer, exposing the employee to the hazard of being struck by the wheels of the trailer.     (B) Multiple employees were sitting with their legs hanging over the side of a moving trailer being pulled by a flatbed truck, exposing the employees  to the hazard of falling off of the trailer and being struck by the wheels of the moving vehicle.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at each workplace, a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), (h) will be met.     1910.1200-(f) Labels and other forms of warning;    1910.1200-(g) Safety data sheets;                    1910.1200-(h) Employee information and training;    On or about 8 September 2016, the employer did not develop or implement an effective written hazard communication program at the workplace where employees were using hazardous chemicals such as, but not limited to N-TEXX Soil Inoculant with Humic Acid, N-TEXX 15-5-5, N-TEXX Soil Inoculant with Humus, and Waste Away, exposing the employees to the hazards such as, but not limited to absorption and dermal contact.

29 CFR 1910.141(a)(5): Vermin control. The employees enclosed workplace was not constructed, equipped, and maintained, so far as reasonably practicable, to prevent the entrance or harborage of rodents, insects, and other vermin. A continuing and effective extermination program was not instituted once their presence was detected.    On or about 19 August 2016, the employer did not develop or implement an effective extermination program that prevented the presence of rodents where employees were conducting daily operations, exposing the employees to the hazards such as, but not limited to the contraction of viral and bacterial diseases from the inhalation and direct contact with rodent urine and feces.
