29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  A confined space program, in writing, was not developed and implemented according to the specific requirements as stated at 1910.146(d)(1) through (14), for entry into the feed building bins to free caked grain and product.    (Note: A confined space program includes documented training, with all the elements included in the confined space standard, proper tie-off anchors for fall protection used during entry, ensuring the attendant understands his duties to assist in safe entry for the entrant, including how to implement rescue, lockout of equipment during entry, development and completion of the confined space entry permit, and all other requirements of the confined space program.  The confined space program must be documented in writing and retraining must be made annually if employee's conduct rescue.  If 911 is used for rescue the employer must ensure that the local rescue agency is capable of performing confined space rescue, is able to respond quickly, and has been notified of the employer's reliance on 911 for rescue.  In addition the employees, entrant and attendant, must be able to safely access the top of the bin without exposure to a fall.)  Abatement documentation is required for this violation.

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to Items of this section:  A lockout program and machine specific procedures, that addressed all of the requirements of the standard, 1910.147, was not fully developed and implemented and was not in writing, for work that included, but was not limited to, the greasing of motor bearings at the top of the feed building where an employee was exposed to an unguarded chain and sprocket, greasing of motor bearings at the top of the fertilizer building where an employee was exposed to an unguarded belt and pulley, and other maintenance activity, such as greasing of other equipment.  (Lockout procedures must fully address all of the elements as stated at 1910.147(c)(4)(ii)(A) through (D).  Documented training is required, proper hardware must be provided and used, testing of equipment after lock application must be made, and all of the other requirements of the standard must be implemented.)  Abatement documentation is required for this violation.
