OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to falls in excess of eight feet from voids created by the cargo hold/hatch walls and the cargo. 1) Alabama State Docks, Star Isfjord, Cargo Hold #2 (Hatch #2): On or about August 25, 2016 and at times prior, the employer exposed employees to fall hazards of up to 43 feet and injuries of the eye, in that employees were permitted to inflate polywoven (Hippo) bags with an air nozzle that was not equipped with a pressure gauge or other safety feature to prevent over inflation.

29 CFR 1918.32(b): The edge of a hatch section, or of stowed cargo, was not guarded by a vertical safety net or other means providing equal fall protection to exposed employees. 1) Alabama State Docks, Star Isfjord, Cargo Hold #2 (Hatch #2): On or about August 25, 2016 and at times prior, the employer did not ensure a fall protection method was implemented and/or used while employees were working on top of stowed cargo, where voids were created by the corners of the cargo hold (hatch) and the cargo, exposing employees to falls of up to 43 feet.
