29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 09/06/16, on a jobsite at 1145 Hertel Ave., Buffalo, NY where a roof on a house was being replaced: Employees engaged in construction work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs, ladders, scaffolds and other surfaces, electrical hazards, unguarded tools/machines, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT DOCUMENTATION REQUIRED

The roof pitch was 10 in 12. There were a few slide guards (roofing Jacks) installed parallel to the roof eaves in some areas of the roof, but no fall protection system was utilized. NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Black Rock Roofing (1946), Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 964634, citation number 1, item number 4, and was affirmed as a final order on May 1, 2014, with respect to a workplace located at 78 Gardenwood Ln., Tonawanda, NY 14223. a) On or about 09/06/16, at the front of a house at 1145 Hertel Ave., Buffalo, NY: An employee was exposed to a potential fall of approx. 15 ft. to the ground when an extension ladder was used to access the upper porch of the house. The siderails of the ladder only extended approx. 18 inches above the roof edge. b) On or about 09/06/16, in the driveway on the east side of a house at 1145 Hertel Ave., Buffalo, NY: Employees engaged in roofing work were exposed to a potential fall of approx. 20 ft. to the ground when an extension ladder was used to access the pik on a ladder jack scaffold. The siderails of the ladder only extended approx. 21 inches above the pik. c) On or about 09/06/16, in the driveway on the west side of a house at 1145 Hertel Ave., Buffalo, NY: Employees engaged in roofing work were exposed to a potential fall of approx. 20 ft. to the ground when an extension ladder was used to access the pik on a ladder jack scaffold.
