Employees removed building exterior transite paneling containing twenty percent chrysotile asbestos.  This work was Class II asbestos work.  The employees used hammers to punch holes through the transite and then pried off sections.  The work was conducted without use of wet methods.  The employer's negative exposure assessment was based upon sampling data collected during work involving transite.  The employer's negative exposure assessment was not demonstrated through sampling data of Class II work involving transite paneling using engineering controls and work practices that closely resembled the engineering controls and work practices used on 9/1/16 at The Western Sugar Cooperative.  This condition exposed employees to an asbestos hazard.

The transite debris was identified as being the same transite as was removed on 9/1/16.  Excel Environmental Inc did not clean-up and dispose of all debris contaminated with asbestos promptly after its removal on 9/1/16.  This condition exposed employees of The Western Sugar Cooperative to an asbestos hazard.

Transite debris fell upon the plastic sheet at ground level beneath their work.  The regulated area established beneath the area of transite removal was not provided with warning signs.  This condition exposed employees of The Western Sugar Cooperative and employees of Precision Industrial Contractors Inc to an asbestos hazard. This work was Class II asbestos work.  The employees set up containment on the interior of the exterior wall of the third level of the boilerhouse where the transite was removed.  The contractor used hammers to "punch out" holes in the transite, which caused the hammer to penetrate through the transite.  This action punched holes through the containment and propelled debris onto the third level floor.  Transite debris was found on 9/16/16 on the third level floor and the first level of the boilerhouse in the area where The Western Sugar Cooperative employees were working.  The competent person did not inspect to ensure the integrity of the containment.  This condition exposed employees of The Western Sugar Cooperative to an asbestos hazard.
