29 CFR 1926.1101(f)(1)(iii): Representative 30-minute short-term employee exposures were not determined on the basis of one or more samples representing 30 minute exposures associated with operations that are most likely to produce exposures above the excursion limit for employees in each work area. (a) Excel Environmental, Inc. at 4701 Brighton Blvd in Denver, CO 80216: On or before October 10, 2017, the employer did not collect representative 30-minute short-term employee exposure samples associated with operations that are most likely to produce exposure above the excursion limit in each work area, in that all of the 19 excursion samples were taken during the first 30 minutes of work. This sampling scheme did not represent the exposures that were most likely to produce exposures above the excursion limit. This condition exposed employees to asbestos hazards.

29 CFR 1926.1101(o)(3)(i)(D): The competent person did not supervise all employee exposure monitoring required by this section and ensure that it is conducted as required by paragraph (f) of this section: (a) Excel Environmental, Inc. at 4701 Brighton Blvd in Denver, CO 80216: On or before October 10, 2017, the competent person did not supervise all employee exposure monitoring required by this section and did not ensure that it was conducted as required by paragraph (f) of this section. None of the 19 excursion samples were taken when the associated exposures were likely to be above the excursion limit. Calibration and sample set up was not done in accordance with the sampling and calibration method. The laboratory results were incorrect for 10 of the samples, and the competent person was not able to use the sample results to direct corrected work practices. In addition, the competent person did not provide adequate supervision for employees using sampling pumps, in that the competent person did not direct the employees on when to turn the pumps on and off. This condition exposed employees to asbestos hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks. (a) Excel Environmental, Inc. at 4701 Brighton Blvd in Denver, CO 80216: On or before October 10, 2017, the employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks. Chemicals used at this site include control green low odor mastic remover, Inline Super Poly Tack 4 and ABC Asbestos Binding Compound. This condition exposed employees to chemical hazards.

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) Excel Environmental, Inc. at 4701 Brighton Blvd in Denver, CO 80216: On or before October 10, 2017, employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. The employer did not provide adequate training to the employees regarding the chemicals used at this site, such as, but not limited to, the control green low odor mastic remover, Inline Super Poly Tack 4, and ABC Asbestos Binding Compound. This condition exposes employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards.
