29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about September 23, 2016, employees were exposed to electrical shock when the boom from the concrete pump they were working with came in contact with energized electrical lines. The employer failed to ensure the employees were adequately instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.416(a)(1): No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means. On or about September 23, 2016, an employee was exposed to electrical shock when the boom from the concrete pump he was working with came in contact with energized electrical lines. The employer failed to ensure work was not conducted in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.416(a)(3): Before work is begun the employer shall ascertain by inquiry or direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, is so located that the performance of the work may bring any person, tool, or machine into physical or electrical contact with the electric power circuit. The employer shall post and maintain proper warning signs where such a circuit exists. The employer shall advise employees of the location of such lines, the hazards involved, and the protective measures to be taken. On or about September 23, 2016, an employee was exposed to electrical shock when the boom from the concrete pump he was working with came in contact with energized electrical lines. The employer failed to ensure by inquiry or direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, is so located that the performance of the work may bring any person, tool, or machine into physical or electrical contact with the electric power circuit. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about September 23, 2016, an employee was exposed to electrical shock and hospitalized when the boom from the concrete pump he was working with came in contact with energized electrical lines. The employer failed to report the hospitalization within twenty-four (24) hours. Abatement certification is required of this item in accordance with requirements of 29 CFR 1903.19(c).
