29 CFR 1910.134(c)(1): The employer did not establish, implement, and/or maintain a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer which demonstrated how the criteria in 29 CFR 1910.134 (a), (b), (h), and (i) will be met. 1910.134 (a) Procedures for selecting respirators; 1910.134 (b) Fit testing procedures for tight-fitting respirators; 1910.134 (h) Training of employees in proper use of respirators including putting on and removing them, any limitations on their use, and their maintenance; 1910.134 (i) Procedures for regularly evaluating the effectiveness of the program; On or about 5 October 2016, the employer did not implement an effective written respiratory protection program where respiratory protection was required to protect the health of an employees spraying chemicals such as but not limited to Line-x bed liner and Type IV CARC paint exposing them to an inhalation hazard.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at each workplace, a written hazard communication program which describes how the criteria specified in paragraphs (g), and (h) will be met. 1910.1200-(g) Safety Data sheets; 1910.1200-(h) Employee information and training; On or about 5 October 2016, the employer did not implement an effective written hazard communication program at the workplace where employees were using hazardous chemicals such as but not limited to Line-X, Type IV Polymeric CARC Paint, and N-Methylpyrrolidone exposing the employees to hazards such as, but not limited to inhalation, absorption, and dermal contact.
