29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   On or about October 18, 2016, employees were exposed to skin and respiratory irritation while applying Senergy Senerflex to a residential property and the employer did not implement or maintain a hazard communication program to ensure employees were familiar with the hazards associated with silica.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about October 18, 2016, employees applying stucco to a residential property were exposed to a fall over 25 feet while working from a metal framed scaffold that did not have a complete guardrail in place, and the employer did not ensure the employees were adequately protected from a fall.  Fox Valley Construction Group Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1112298, citation number 1, item number 2 and was affirmed as a final order on January 26, 2016, with respect to a workplace located at 2599 W. Higgins Rd. Hoffman Estates, IL 60169.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
