29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:    On or about October 20, 2016, employees used handheld angle grinders with the guards removed, exposing employees to the hazards associated with operating power tools without guards.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(c)(2)(ii): Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer shall only be allowed after the manufacturer issues specific written approval.     On or about October 20, 2016, the employer did not receive written approval from the manufacturer prior to deviating from the manufacturer's tabulated data for the trench box, serial number M16010133, exposing employees to the hazards associated with a trench box failure.      Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems were not used and maintained in a manner that would have prevented employee exposure to hazards.   On or about October 20, 2016 employees were allowed to work inside of a trench box that was not used in the manner intended by manufacturer, by performing the following activities:   a. The lower spreader was removed from the west side of the trench box.   b. A spreader was cut to fit in at the center of the trench box and welded into place.    c. Two (2") diameter pins were not placed in the spreader and the collar connection had been removed.   Employees were exposed to the hazards associated with a trench box failure.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
