29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or before October 19, 2016 where employees worked at heights exceeding 6 feet and/or 10 feet while using scaffolding, the employer did not have a safety program that addressed the identification of fall hazards or the measures to be taken to prevent falls.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. On or before October 19, 2016 where an employees was working from an elevated aerial lift platform, the employee was not protected from falls by the use of a harness and lanyard, thereby being exposed to a 34 foot fall hazard.
