29 CFR 1926.651(k)(1):  An inspection of the excavation, the adjacent areas, and protective systems was not conducted by a competent person prior to the start of work and as needed throughout the shift:      The employer did not ensure the inspections were conducted by a competent person who had knowledge to identify hazards associated with working in an excavation.  An employee was exposed to cave-in hazards when working in an unprotected excavation approximately 6 feet in depth, approximately 8 feet wide, approximately 57 feet in length, and comprised of material consistent with that of a Type B soil.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp, or other safe means of egress was not located in trench excavations that were 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees:      The employer did not ensure that a safe means of egress, such as a stairway, ladder or ramp was provided for employees working in a trench that was approximately six (6) feet in depth.    The company (L W Contractors, Inc.) was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1076518, citation number 1, item number 1 and was affirmed as a final order on 09/01/2015, with respect to a workplace located at Fortune & Frank Scott Parkway, Shiloh, IL  62269.

29 CFR 1926.652(a)(1):  Employees in excavations were not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) sloping and benching or (c) support/shield/protective systems of this section:      The employer failed to provide cave-in protection such as sloping, benching, or use of a trench box when employees were working in an excavation approximately six (6) feet in depth, approximately eight (8) feet wide, approximately fifty-seven (57) feet in length, and comprised of material consistent with that of a Type B soil.     The company (L W Contractors, Inc.) was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1076518, citation number 1, item number 2 and was affirmed as a final order on 09/01/2015, with respect to a workplace located at Fortune & Frank Scott Parkway, Shiloh, IL  62269.
