29 CFR 1910.178(p)(1): The employer did not ensure that a powered industrial truck found in need of repair, defective, or in any way unsafe, was taken out of service.     a) Jobsite - On or about 11/18/2016, The Hyster H86L powered industrial truck, that was not taken out of service, had a hydraulic leak and broken seat, exposing employees to lacerations and struck by hazards.

29 CFR 1910.178(q)(7): The employer did not ensure that industrial trucks were being examined before being placed in service at least daily. Defects were not immediately reported and corrected.    a) Jobsite: On or about 11/18/2016, examinations on powered industrial trucks were not being conducted consistently. Visible defects on forklifts were not reported, resulting in forklifts in disrepair being used which exposes employees to various hazards such as struck-by hazards.
