29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   On or about January 24, 2017, in the plant production area, where employees were exposed to noise hazard without a continuing, effective conservation program in place:  a) The filling line machine operator, was exposed to a noise level of 91.67 dBA during a 214 minutes sampling period on January 24, 2017; b) The filling line machine operator was exposed to a noise level of 90.67 dBA during a 286 minutes sampling period on January 24, 2017; c) The filling line machine operator, was exposed to a noise level of 88.39 dBA during a 308 minutes sampling period on January 24, 2017; and, d) The back-up operator, was exposed to a noise level of 86.66 dBA during a 325 minutes sampling period on January 24, 2017.

Resina Automatic Screw Cappers Machine System 873; b. Packaging Dynamics In-line Filler Machine System; c. MGL Labeling Machine; d. Enercon Induction Sealer Machine; e. Resina Automatic Screw Cappers Machine System S30; f. Surekap Automatic Screw Cappers Machine System; g. Accutek Tub Filler Machine System; h. Simplex In-line Filler Machine System; and, i. Federal 12 Head Rotary Filler Machine System.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   On or about January 24, 2017, and times prior thereto, at this facility, employees involved in production of aloe vera food products and cosmetics, and were exposed to chemicals, such as, but not limited to, corrosives, such as bases and acids, oxidizers and peroxides, heavy duty cleaners, disinfectants, sanitizers and industrial food process chemicals. The employer had not implementing his program which would address labeling and other forms of warning on chemicals containers, Safety Data Sheets and employees information and training on the hazards associated with chemicals used at this site.  The written program must also contain the following:  a.    a list of all hazardous chemicals on site; b.    the methods the employer will use to inform employees of the hazards associated with non-routine tasks involving          chemicals, such as a spill; c.    the hazards of chemicals contained in piping that is not labeled; and, d.    the method the employer will use to inform other employers (contractors) of the chemicals their employees might        be exposed to while performing duties at this site.
