OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from rollover while operating a forklift without a restraint system. Location: 2-44 Cornelia, St., Newark, NJ (Produce Packaging Area) a) A powered Industrial Equipment, Forklift Model #TMC Pro Cb 15, was not equipped with operator restraint devices or seat belts. An employee was observed operating the forklift without the use of seat belt; on or about 12/8/16.

29 CFR 1910.36(d)(1): Employees must be able to open an exit route door from the inside at all times without keys, tools, or special knowledge. A device such as a panic bar that locks only from the outside was not provided. Location: 84 Lockwood St., Newark, NJ. a) In the event of an emergency some employees may require special knowledge on how to operate the door in its current condition. There was no panic bar provided at the emergency discharge door; on or about 12/8/16.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure. Location: 2-44 Cornellia St., Newark, NJ (Produce Packaging Area) a) Employer utilized various temporary extension cords as a permanent connection to power an industrial heavy duty light fixture. The extension cords were not used as specified as employer used it to capacity daily thereby increasing overheating and thus creating a potential fire hazard at the facility; on or about 12/18/16.
