29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: On or about August 4, 2017, the employer failed to submit documentation and certification of corrective action for that the following hazards have been abated: a) On or about January 23, 2017, Citation 1, Item 1, employees were exposed to struck-by hazards from wood chips and nails, and fall hazards of approximately 14.6-feet to greater than 25-feet when the employer did not conduct inspections of the jobsite and employees. b) On or about January 23, 2017, Citation 2, Item 1, employees were exposed to struck-by hazards from wood chips and nails when they used nail guns without wearing eye protection. c) On or about January 23, 2017, Citation 2, Item 2, employees were exposed to fall hazards of approximately 14.6-feet to greater than 25-feet when they used rock climbing harnesses which attached the life line at the front of their waists. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
