29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training. On or about 2/14/2017, Metro Metal Recyclers, Inc. had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training. Two employees were operating powered industrial trucks without required training.

29 CFR 1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, and the truck was not taken out of service until it had been restored to safe operating condition. On or about 2/14/2017, employees at Metro Metal Recyclers, Inc., located at 4427 Geraldine Ave., St. Louis MO, were operating powered industrial trucks in need of repair, defective, and unsafe. The following trucks were unsafe and not removed from service until restored to safe operating condition: a) Tusk Forklift, Model 500PG-14, Serial # 591707A: The unit had a damaged seat; cardboard attached to the cage obstructing the operators view; was missing LPG locator/indexing pin; had damaged front tires; was missing pedal pads; and an inoperable horn without the horn button. b) Toyota Forklift, Model 7FGU25, Serial # 84993: The unit had a damaged seat; aluminum attached to the cage obstructing the operators view; damaged rear tires and was missing pedal pads. c) Doosan Daewoo, Model G25E: The unit had a damaged seat; aluminum attached to the cage obstructing the operators view; was missing LPG locator/indexing pin; had damaged rear tires; was missing pedal pads; and a broken and inoperable lights.
