29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:    a) Jobsite, front yard: On February 24, 2017 and at times prior thereto employee(s) worked in a 10 foot deep trench where the shielding in place was not adequate to protect them from a cave-in hazard.  A single section of shielding was used at the top of the trench, leaving approximately 5 and a half feet under the shielding unprotected.  The employee(s) were not trained to recognize the severity of this hazardous situation and take the necessary actions to correct it.        b) Jobsite, front yard: On February 24, 2017 and at times prior thereto employee(s) worked in a 10 foot deep trench.  Shielding or another cave-in protective system was not in place at the vertical end walls. The employee(s) were not trained to recognize the severity of this hazardous situation and take the necessary actions to correct it.        c) Jobsite, backyard: On February 24, 2017 an employee entered a 7 foot deep trench where cave-in protection was not in place.  The employee was not trained to recognize the severity of this hazardous situation and potential fatal consequences of his actions. 29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    a) Jobsite, front yard: On February 24, 2017 and at times prior thereto an inspection by a competent person was not performed on a 10 foot deep, vertically walled trench prior to allowing any employee to enter the trench.  A 4 foot section of shielding that was in place on two of the sides was not installed per the manufacturer tabulated data.  Only two spreaders were installed instead of the required 4 per section.  This left approximately 5 and a-half feet of unprotected trench below the shielding.  No cave-in protection was in place on the two vertical end walls of the trench.    b) Jobsite, back yard: On February 24, 2017 and at times prior thereto an inspection by a competent person was not performed on a 7 foot deep, vertically walled trench.  An employee entered the trench when no cave-in protection was in place.             Note) Certification and documentation for corrective actions ARE required for this item.
