29 CFR 1910.178(l)(2)(ii):     Training did not consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    On or about 3/13/2017, Mid-America Precast, Inc. had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely.  The employers training program did not include formalized training or an evaluation of the operators performance.

29 CFR 1910.178(p)(1):   A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, and the truck was not taken out of service until it had been restored to safe operating condition.  On or about 3/13/2017, an employee at Mid-America Precast, Inc., was operating a Caterpillar forklift, serial # 1CN90125, in need of repair, defective, and unsafe.  The forklift was missing a LPG locator/indexing pin, had a damaged LPG tank hold-down strap and an improperly installed LPG tank.  The forklift was not removed from service until restored to safe operating condition.

29 CFR 1910.178(q)(1):   Any power-operated industrial truck not in safe operating condition was not removed from service.  On or about 3/13/2017, an employee at Mid-America Precast, Inc., was operating a Caterpillar forklift, serial #  1CN90125, which was not in safe operating condition and not removed from service.  The forklift had the following issues:      a)  A missing LPG tank locator/indexing pin.     b)  A damaged LPG tank hold-down strap; the straps fastener was missing and repaired with wire.     c)  The LPG tan was not installed correctly.

29 CFR 1910.179(j)(3):   A complete periodic inspection of crane(s) had not been conducted in the past 12 months.  On or about 3/13/2017, Mid-America Precast, Inc. had not conducted periodic inspections for the following overhead cranes:  West Bay  P & H 5 ton, Serial #7299; no rated load test or hook certification record on file/hand, missing a hook hasp and the pendant wire was damaged/missing insulation and concrete covering the hook block.  East Bay/North side  Shaw Box 10 ton, Serial #K685792; no rated load test or hook certification record on file/hand.  East Bay /South side  Shaw Box 10 ton, Serial #99H16715; no rated load test or hook certification record on file/hand.  Steel Shop West  Robbins & Myers 10 ton, Serial #46891VY2; no rated load test or hook certification record on file/hand and rated load of the crane was not marked on each side of the crane.  Steel Shop East - Robbins & Myers 10 ton, Serial #46891VY1; no rated load test or hook certification record on file/hand.

29 CFR 1910.184(d):     Each day before being used, the employer did not ensure that slings and all fastenings and attachments were inspected for damage and/or defects by a competent person prior to utilization.  Damaged or defective slings were not immediately removed from service.    On or about 3/13/2017, Mid-America Precast, Inc. did not ensure that slings and all fastenings and attachments were inspected prior to utilization.  The following damaged or defective slings were not removed from service:    a)  No identification tag and proof load test on sling hanging on a Robbins & Myers 10 ton crane, Serial #46891VY2, located in the steel shop.    b)  An alloy steel chain hanging on the wall of the steel shop was missing hasps on all four hooks.    c)  The sling hanging on the P & H 5 ton crane, Serial #7299; in the west bay had kinked and bent cables and a nail inserted into a holding a pin.
