29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about 9 March 2017 and at times prior thereto, an employee without eye protection was performing framing activities on a three story multi-family residence under construction, exposing the employee to the hazard of being struck in the eyes by flying objects.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about 9 March 2017 and at times prior thereto, an employee without fall protection was performing framing activities at the top of the third story of an apartment building under construction, exposing the employee to the hazard of falling approximately 37 feet to the ground below. L.W. Bailey Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 981752, citation number 1, item number 1 and was affirmed as a final order on August 20, 2014, with respect to a workplace located at11300 Farrah Lane, Austin, TX 78747.
