29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a) On or about April 24, 2017 for employees exposed to struck-by and cave-in hazards while installing footings from an excavation with a maximum depth of approximately 7 feet where a spoil pile was placed on the edge of the excavation and where protective systems were not installed at the work site located near 1135 South Highland Acres Road in Bismarck, North Dakota.
