29 CFR 1926.59:  As referenced by 1910.1200(e)(1), At his job site, the employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, for employees exposed to hazardous chemicals at the jobsite:  a) At 558 Saint Francis Street Mobile, Alabama: On or about April 25, 2017, and at times prior; the employer did not develop, implement or train employees on a written hazard communication program to assist employees using hazardous chemicals such as but not limited QUIKRETE Mortar Mix, PVA (Poly(vinyl acetate)) Drywall Primer & Sealer, and Drylox Masonry Waterproofer.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) At 558 Saint Francis Street Mobile, Alabama: On or about April 25, 2017, and at times prior; employees on the ground putting materials in a bucket to be hoisted up two or three stories (plus 25 feet) were under and/or near the load without wearing hard hats to protect them against falling tools, materials and/or debris from next and upper floor levels.

29 CFR 1926.304(i)(1): Each circular had-fed ripsaw was not guarded by a hood whcih completely enclosed that portion of the saw above the table and that portion of the saw above the material being cut:  a) Ryobi Table Saw (Model No. R4510, Serial No. Z11974749T): On or about April 25, 2017, and at times prior; employees were exposed to struck-by and amputation hazards in that the employer required, observed and allowed employees to use an unguarded table saw without any safety protections.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) At 558 Saint Francis Street Mobile, Alabama: On or about April 25, 2017, and at times prior; the employer allowed and required employees to perform painting and demolition operations without fall protection at and near window openings whose frames were removed; exposing employees to fall  hazards up to twenty five (25) feet to the ground below.
