The water was approximately 6 inches deep.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:      a) On or about April 28, 2017 and at times prior, an employee was exposed to serious hazards while working inside a trench of approximately 6 feet 6 inches deep. The foreman/competent person did not remove the employee working in the trench. The water inside the trench was approximately 6 inches deep, the bottom of the shield of the trench box was approximately 3 feet 6 inches above the bottom of the trench, and an extension ladder was located outside the trench box.

29 CFR 1926.652(g)(2): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of a shield system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the shield:      a) On or about April 28, 2017 and at times prior, an employee was exposed to serious hazards while working inside a 6 feet 6 inches deep trench. The foreman/competent person had the bottom of the shield approximately 3 feet 6 inches above the bottom of the trench. The manufacturer's tabulated data of the trench box recommends the bottom of the shield may be a maximum of 2 feet above the bottom of the trench.
