OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a rack collapse and overhead struck-by hazards while installing a SK2000 rack system: On or about May 15, 2017, employees were exposed to struck-by and crushed-by hazards during the installation of a Steel King SK2000 rack system that was not bolted to the floor per the manufacturer's specifications. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about May 15, 2017, an employee was operating a Clark forklift that had the following attachments: a. Husky Vehicle Recovery Straps were used as slings for free rigging the materials from the underside of the tines of the forklift. The company had not received approval from the manufacturer of the forklift prior to using the attachments, exposing employees to a struck-by hazard. b. Hart C-clamps were used for holding the straps from sliding off the forks of the forklift while free rigging the load. The company had not received approval from the manufacturer of the forklift for the use of the attachments, exposing employees to a struck-by hazard. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
