29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about June 16, 2017 and at times prior thereto, at the jobsite located at 2 Oakridge Lane, Maumelle, Arkansas, employees who were standing on the 1/12 sloped patio roof while building a chimney eight feet above the ground below were not using fall protection. This condition exposed employees to the hazard of falling to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about June 16, 2017 and at times prior thereto, employees who had been exposed to fall hazards for one week while working on a patio roof had not been trained to recognize the hazards of falling and procedures to followed to minimize those hazards.
