29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  On or about July 14, 2017 and there prior, the employer authorized employees and subcontract-employees to operate powered industrial trucks without ensuring that they were competent operators. Employees were not trained and evaluated according to the specifications in paragraph (l).

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  On or about July 14, 2017 and there prior, employees operating CAT rough terrain and Skytrak forklifts at the residential construction site did not complete formal instruction training on Powered Industrial Trucks. Employees did not have the requisite knowledge to operate the equipment and lift materials in a safe manner.

Employees used the forklift to lift metal guard-railings to the third floor at a residential construction site.

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems:  On or about July 14, 2017 and there prior, the employer exposed employees handling and taking off an approximately 350 pounds iron railings from a rough terrain onto an unguarded third floor breezeway to fall from height hazards.
