29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.           (a)   At the worksite, an employee with the job title of machine operator was exposed to continuous noise in excess of an 8-hr Time Weighted Average (TWA) of 85 dBA without the benefit of participation in a Hearing Conservation Program; on or about 9/20/17.    Employee was engaged in operating the stamping machine.                 Noise sampling data:    Exposure calculations assumed a zero increment for the unsampled remainder of the 8-hr day.  Stamping Area: Machine Operator: % Noise :71.6 or 8 hr equivalent 87.5 dBA; Sample time was 450 mins. for the 80 dBA Threshold.          Employees exposure to Continuous Noise levels above 85 dBA without benefit of protection can result in permanent hearing loss, impairment, stress and headache.       ABATEMENT NOTE:    A continuing effective Hearing Conservation Program, shall be provided at no cost to the affected employee(s).  Elements essential to a Hearing Conservation Program include at a  minimum:               1.    AUDIOMETRIC TESTING              The employer shall establish and maintain a Audiometric              Testing Program.  This program must be available to all              employee(s) whose exposure equals or exceeds an 8-hr TWA of              85 decibels (dBA).  The audiometric testing shall be provided              annually to all effected employee(s).     Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
