29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  A)    West side of the new Carter's under construction, 700 Route 73 South, Marlton, NJ 08053: Employees were not using any type of head protection when working on the upper levels, below, and adjacent to the base of the approximately 80 foot long x 20 foot high fabricated frame scaffold, or about 08/22/2017.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(c)(2)(i): Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement:  a)    West side of the new Carter's under construction, 700 Route 73 South, Marlton, NJ 08053:  The base plates of the approximate 80 foot long x 20 foot high fabricated frame scaffold masons were working from up to approximately 20 feet above ground level did not rest on adequate mud sills; 2-3 mud sills broken & base plates straddling the edge of at least 2 mud sills, on or about 08/22/2017.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  A)  West side of the new Carter's under construction, 700 Route 73 South, Marlton, NJ 08053:  Employees climbed down, using the end frames and cross braces, from the approximately 17 foot level of the approximate 80 foot long x 20 foot high fabricated frame scaffold, on or about 08/22/2017.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)    West side of building:    Employees without any fall protection were working from the approximate 17 foot level mason's platform of the approximate 80 foot long x 20 foot high x 7 foot deep fabricated frame scaffold, on or about 08/22/2017.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects:   A)    West side of the new Carter's under construction, 700 Route 73 South, Marlton, NJ 08053:  Employees were exposed to being struck by potentially falling objects when they worked at a lower level or around the base of the approximate 80 foot long x 20 foot high fabricated frame scaffold not having toeboards or some other means of protection, on or about 08/22/2017.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
