29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a- Building 3 - Foundry Road, Pennington NJ: Company worksite employees, not wearing head protection, was exposed to struck by hazards when working beneath a company employee using unsecured hand tools, pneumatic nailers, etc. This condition was observed on or about 01/03/18.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- Building 3 - Foundry Road, Pennington NJ: Employees were exposed to fall hazards, in excess of 11 feet to the ground surface below, when performing framing and other related activities from unprotected edges and while working/walking from the top plates of exterior walls without the use of fall protection. Condition observed on or about 01/03/18. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a- Building 3 - Foundry Road, Pennington NJ: Company worksite employees were exposed to fall hazards up to and in excess of 11 feet to the ground surface below when performing framing and other related activities while working/walking from unprotected edges and while working/walking from the top plates of exterior walls without the use of fall protection. At the time of the inspection, these employees had not received training regarding the identification, elimination, etc. of fall hazards by a competent person. This condition was noted on or about 01/03/18. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The ladder's manufacturer requires that the ladder be used in the fully opened position with each of its legs locked.
