29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   (a)  New Retirement Center, 19301 Eastland Center Ct, Independence, MO - On August 24, 2017, employees engaged in construction activities on the top of the project were exposed to fall hazards up to approximately 43 feet above the ground, in that there was no Fall Protection Equipment or Fall Protection System in use.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift.  (a)  New Retirement Center, 19301 Eastland Center Ct, Independence, MO - On August 24, 2017, an employee engaged in construction activities while operating an elevated JLG LIFT was exposed to fall hazards up to approximately 43 feet above the ground, in that the he had not attached his safety lanyard to the basket anchor point to prevent potential catapult from the basket.
