29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    Noise Monitoring was not conducted for employees with the following exposures:    a) Production Area: A laborer that was bagging and palletizing pre mixed ingredients was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 100% of the permissible level (90 dBA) and was equivalent to approximately 90.0 dBA. The sampling was performed for 433 minutes during one 8 hour shift, on or about 9/13/17. Zero exposure was assumed for the unsampled period of time.    b) Production Area: A laborer that was bagging and palletizing pre mixed ingredients was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 77.49% of the permissible level (90 dBA) and was equivalent to approximately 88.1 dBA. The sampling was performed for 433 minutes during one 8 hour shift, on or about 9/13/17. Zero exposure was assumed for the unsampled period of time.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    Audiometric Testing was not conducted for the employees with the following exposures:    a) Production Area: A laborer that was bagging and palletizing pre mixed ingredients was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 100% of the permissible level (90 dBA) and was equivalent to approximately 90.0 dBA. The employer did not institute a training program and ensure employee participation in the program:    A training program was not instituted for employees with the following exposures:    a) Production Area: A laborer that was bagging and palletizing pre mixed ingredients was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (PEL). The employee's dosimeter dBA level was 100% of the permissible level (90 dBA) and was equivalent to approximately 90.0 dBA. 29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  a) Production Area (Wet Line Arm): An employee Sperian FREEDOM 2000 Series half mask respirator was not stored properly, on or about 9/6/17.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
