29 CFR 1926.1053(a)(2): The employer did not ensure ladder rungs were uniformly spaced when the ladder was in position for use:  On or about August 29, 2017 employees were exposed to fall hazards of  9 ft. onto concrete steps while accessing a roof from a portable ladder which was missing a rung.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper level landing surface, the ladder did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    On or about August 29, 2017 employees were exposed to fall hazards of  9 ft. onto concrete steps while accessing a roof from a portable ladder and the side rails did not extend at least 3 ft. above the level being accessed and the ladder was not secured at the top to a rigid support.
