29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a)  On or about September 20, 2017, at the above addressed jobsite - North Creek Builders, LLC did not train its employees on how to recognize, minimize, control or eliminate their exposure to the hazards of the jobsite addressed above.  The employees were thereby exposed to serious cave-in hazards.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a) On or about September 20, 2017 - at the above addressed jobsite, an inspection of a trench, measured at six (6)  and three tenths (3/10) feet in depth, was not conducted by a competent person, thereby exposing employees to serious cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) On and about September 21, 2017, at the above addressed jobsite, an employee of North Creek Builders Llc was working within a 6 and 3/10th ft excavation without cave-in protection.  The employee was exposed to serious cave-in hazards.
