29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:                    Hazard Communication Program:  The written hazard communication program was inadequate.  Employees use hazardous chemicals such as Quikrete, Portland cement, pool chemicals, various paints and cleaning products, and flammable paint thinners. The following elements were missing from the program:                 1. A list of chemical products currently being used in the workplace;   2. Current Safety Data Sheets (SDS's) to replace the former Material Safety Data Sheets;                2. A description of the new pictogram system;              3. A description of the labeling system that will be used in the workplace;   4. A description of the training and information provided to affected employees

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:                    Maintenance and Housekeeping:  Employees were not trained on the new label elements (e.g., pictograms and signal words) and the new SDS formation by December 2, 2013, as required by the revised Hazard Communication Standard.  Employees use hazardous chemicals such as Quikrete, Portland cement, flammable paint thinners, pool maintenance products, and various paints and cleaning solutions.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):   Maintenance/housekeeping: The employer has provided employees with personal protective equipment (PPE) such as gloves, boots, and protective eye and face wear to be worn when performing maintenance and housekeeping duties such as mixing and using cleaning products, adding pool chemicals, or hydroblasting.  The use of PPE is a job requirement.  A hazard assessment has not been performed to include the following elements:                    1.  Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment;  2.  Communicate the selection decisions to each affected employee and;  3.  Select PPE that properly fits each affected employee.
