29 CFR 1926.59: As referenced by 29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use On or about November 15, 2017 at the worksite located at or near 1700 Highway 5 in Benton, Arkansas, the employer did not have Safety Data Sheets for the chemicals used in the workplace to include, but not limited to, Sherman Williams ProMar 200 paint. Employees used the paint to paint the interior of the Benton Police and Fire station.

29 CFR 1926.59: As referenced by 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about November 15, 2017 at the worksite located at or near 1700 Highway 5 in Benton, Arkansas, employees painting the interior of a new construction were not provided any information or training on the chemicals used in the worksite to include, but not limited to, Sherman Williams ProMar 200 White Paint. This condition exposes employees to chemical hazards.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. On November 14, 2017 and times prior thereto, at the worksite located at or near 1700 Highway 5 in Benton, Arkansas, the employer did not ensure a workplace inspection was performed in the area in which the scissor lift was to be used for possible hazards, such as but limited to, hazardous locations and other possible unsafe conditions. Employees used a scissor lift in the path of an operational bay-garage door which unexpectedly energized and tipped over the scissor lift. This condition exposed employees to fall from height hazards.
