29 CFR 1910.180(d)(4):     Complete inspection(s) of crane(s) following the requirements of paragraph 1910.180(d)(3) and (d)(4)(i-x) were not performed at intervals as generally defined in 1910.180(d)(2)(i) with a determination made as to whether deficiencies constituted a safety hazard:      a)  237 St. Cloud Avenue, West Orange, NJ.    The employer had not performed inspections at daily to monthly intervals of the crane's components as required on the National Crane Corporation 800D, 15 year old truck mounted crane, which was in use on the day of the incident.                                      Violation observed on or about 10/27/2017.

29 CFR 1910.180(h)(1)(i):     A crane was loaded beyond its rated load.    a)  237 St. Cloud Avenue, West Orange, NJ.    While picking a large tree trunk over the front of the crane, the National Crane Corporation Model 800D truck-mounted crane was overloaded causing it to upset.                                      Violation observed on or about 10/27/2017.

29 CFR 1910.332(b)(1):     Employees were not trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertained to their respective job assignments:      a)  237 St. Cloud Avenue, West Orange, NJ and at the Corporate Offices at 1015 South Main Street, Towanda, PA.    The crane operator and his employees were not trained in electrical safety-related work practices including, but not limited to, the hazards of working in the vicinity of high voltage overhead power lines working on and around a crane picking cut tree limbs.                                        Violation observed on or about 10/27/2017.

29 CFR 1910.333(c)(3)(i)(B):     When an unqualified person was working on the ground in the vicinity of overhead lines, the person brought a conductive object closer to unguarded, energized overhead lines than the distances given in 29 CFR 1910.333(c)(3)(i)(A).                NOTE:  1910.333(c)(3)(i)(A)               (1)  For voltages to ground 50kV or below - 10 feet (305 cm);             (2)  For voltages to ground over 50kV - 10 feet (305 cm) plus 4 inches (10 cm) for every 10kV                         over 50kV.      a)  237 St. Cloud Avenue, West Orange, NJ.    An unqualified person working on ground level in the operator's position of the truck mounted crane, brought a conductive object closer to unguarded, energized overhead lines than the distances given in 29CFR1910.333(c)(3)(I)(A).  While using the crane to pick a tree limb over the 13,000 Volt overhead power line, the limb struck the power line.                                        Violation observed on or about 10/27/2017.
