29 CFR 1910.23(b)(9): Ladders were not inspected before the initial use in each work shift, or more frequently as necessary, to identify any visible defects that could cause injury:  a) Linden Bulk Transportation 4200 Tremley Point Road, Linden, NJ site - Wash bay:  Ladders at the worksite were not visually inspected to identify defects that could cause injury before initial use in each work shift. The ladder that was used one November 29, 2018 was not free from visible defects, in that, it was not was not corrugated, knurled, dimpled, coated with skid resistant material, or otherwise treated to minimize the possibility of slipping.    Condition noted on or about 12/7/2017.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not implement a written permit space entry program that complied with 29 CFR 1910.146:  a) Linden Bulk Transportation 4200 Tremley Point Road, Linden, NJ site - Wash bay:  The employer failed to effectively implement the company's written permit space entry program as described in the " LBT Tank Entry Work Procedure". The procedure which required employees to clean and neutralize the tanks, take oxygen level readings was not always followed.   Employees enter tanks containing chemicals such as but not limited to PolyTHF, Pluracol, and latex during the cleaning process to remove the products that coat the interior walls of the tanks. Employees are exposed to oxygen deficient atmospheres.  Condition noted on or about 11/29/2017.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work is regulated by 29 CFR 1910.146, permit required confined spaces, acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned:  a) Linden Bulk Transportation 4200 Tremley Point Road, Linden, NJ site - Wash bay:  Employee training was inadequate to effectively inform tank wash employees of the procedures required for entering a permit required confined space. The written procedure which required employees to clean and neutralize the tanks, take oxygen level readings was not always followed which allowed employees to enter contaminated tanks without eliminating the hazards associated with the chemicals in the tanks.    Observed on/or about 11/29/2017.

29  CFR 1910.28(b)(5)(i): The employer failed ensure each employee on a runway or similar walkway is protected from falling 4 feet (1.2 m) or more to a lower level by a guardrail system:     a) Linden Bulk Transportation 4200 Tremley Point Road, Linden, NJ site - Wash bay:    The cantilevered catwalk from the upper work platform in tank wash bays #2 & #3 were not provided standard guard rails, or equivalent on open sides; exposing worker(s) to falls of 12 feet. Employees who access the catwalk and the top of the tank truck to assist during confined space entries are not protected from falls.    Condition noted on or about 11/30/2017.    The Linden Bulk Transportation, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(2), which was contained in OSHA inspection number 1041033, citation number 1, item number 1 and was affirmed as a final order on 9/1/2015, with respect to a workplace located at4200 Tremley Point Road, Linden, NJ.
