The written program must be made available prior to and during entry operations for inspection by employees and their authorized representatives: On or about December 07, 2017, at the corner of 107th Avenue North and 7th Street North, Naples Florida 34101, the employer permitted employees to grout pipes outside an accessible, new concrete storm-drain manhole box in a trench excavation prior to implementing a written permit space program requiring the identification of all accessible spaces as confined spaces and permit required confined spaces, thus exposing employees to a potentially hazardous atmosphere.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a. On or about December 07, 2017, the corner of 107th Avenue North and 7th Street North, Naples Florida 34101, employees were permitted to work in an 11-foot deep trench excavation with type C soil, that did not have adequate cave-in protection in that employees had to grade soil inside a trench box which used a single road plate which did not cover the entire width and height of the trench excavation and was not designed for cave-in protection by a professional engineer, thus exposing employees to a caught-in between hazard. b. On or about December 07, 2017, the corner of 107th Avenue North and 7th Street North, Naples Florida 34101, employees were exposed to a to a caught-in between hazard where a 6-foot deep section of the trench excavation did not have cave in protection as they descended a ladder to gain access to a manhole.
