29 CFR 1926.20(b)(4): The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.    The employer had not ensured that on December 14, 2017, a Bobcat T590 Crawler vehicle operator was qualified to operator the Bobcat when using a forklift tines attachment and a 15 ft. chain rigged in a vertical lift to lift one ton concrete blocks on top of each other to construct a block wall for an addition to an existing building.

On December 14, 2017, at 4882 Infirmary Road, Miamisburg, a Bobcat T590 Crawler Vehicle operator and another employee was exposed to a struck-by hazard while using a 15 ft. 5/8 inch chain without any affixed identification markings to rig a vertical lift of one ton concrete blocks to stack on top of one another for the construction of an addition to an existing building.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    The employer did not notify OSHA within 24 hours of an employee hospitalization for a workplace injury that occurred at 4882 Infirmary Road, Miamisburg, OH,  on December 14, 2017 until January 12, 2018.
